FTC; Accountability, Transparency and Integrity

Author: Lance Winslow

The Franchising Division at the Federal Trade Commission put forth a report for revamping and upgrading the Franchise Rule. After ten-years of doing nothing they are now moving forward to with these changes. They put out word to the franchising industry for comments on their 432-page totally flawed report.

In this report it is safe to say that there is quite a lot of rear end kissing pre-comments from the attorney based commenters. It is done under the disguise of professionalism, however I believe this type of chit chat in the comments should not be made as it gives the Federal trade Commission a false sense of stardom and importance in their endeavors.

It is safe to say that the current direction of these comments and this report is traveling in the wrong direction, trying to band aide an ill conceived and now out of date set of rules for the franchising industry. If the FTC allows this rhetoric to provide a false sense of self confidence in their abilities and those involved in these comments with a un-deserved inflated ego, then we will most likely see a real problem on the field with referees making up rules while the game is still in play and blowing whistles on perception of rule rather than rule of law. Such chaos spoils the most competitive games and strips deserving athletes of their medals and gives medals to the lesser and undeserving. In which case we may as well throw them over the fence, put more Johns in the house since the new rule makers will continue to be full of crap.

Free Markets are for the strong, leave the ego's to the entrepreneurs, there is no place for ego at the Federal Trade Commission. If one has to act out in such a way, go get a real job or take up men's basketball, soccer or baseball on your own time. Perhaps a jaunt down to the metro-sexual and homosexual bars in DC to show your girly-man-ness might be an idea for the Commission, another field trip on the taxpayer, flagrantly re-violating the government credit card usage? We must hold the Federal trade Commission accountable to capitalism in the purest sense, for this is not a socialist country, no matter what those in the belt way are led to believe within their skewed belief system.

Congratulations to the FTC's Franchising Division on finally finishing this report after 10-years just in time to meet deadline of the 90-year anniversary of the Agency and the start of your next fiscal year? It seems false and misleading to advertise and celebrate a successful run at the FTC, when looking at this delay, although not too surprising as per my personal observation and experience with the agency.

Let's hold the United States Department of Justice's Federal Trade Commission's Consumer Protection Division's Franchising Group accountable for their actions. Just because they have a long name and are associated with other important agencies does not mean they should be able to hide way down the list of public scrutiny. We need accountability, transparency and integrity from this agency. They are using our tax payers money to commit terrorism on the American Business Community. Do you think that is acceptable behavior from such an agency? Think about it.
